What About HOA Requirements?

A permit from the building department and an HOA approval are separate things. Even if no permit is required, your HOA may have its own approval process for repairs that affect common areas, shared walls, or the exterior of the building. Interior cosmetic drywall repairs within your unit generally do not require HOA approval either, but always check your CC&Rs if the repair is in a condo or townhome.

What happens if work is done without a required permit?

If permitted work is done without a permit in Las Vegas, the building department can require the work to be opened up for inspection (even if walls have already been closed), require the work to be redone if it does not pass, and issue fines. More practically, unpermitted work that was required to be permitted can create problems at resale — disclosure requirements in Nevada require sellers to disclose known unpermitted work, and buyers’ lenders may require remediation before closing.

Does my repair contractor pull the permit or do I?

Either can pull the permit depending on the situation. For work that a licensed contractor performs, most Las Vegas building departments prefer or require that the contractor of record pull the permit, since they are taking responsibility for the work. For owner-builder work, the homeowner can pull the permit themselves. If your repair is part of a larger project, clarify with your general contractor who is responsible for the permit before work starts.

I am doing just a drywall patch after a plumber fixed a pipe. Do I need a permit?

For the drywall repair itself, no permit is required. The plumber should have pulled a permit for the plumbing work if it required one.
